This Gift Card & Stored‑Value Policy explains how The Luxurious Massage and Spa handles all purchased gift cards, prepaid cards, stored‑value cards, and gift certificates. We adopt these procedures to protect you, to comply with state and federal law, and to make any recovery of unclaimed funds as straightforward as possible.
Throughout this Policy
This Policy governs all purchased Stored-Value Instruments issued by us, ensuring that they are managed in compliance with applicable laws and regulations. It specifically excludes Promotional Gift Cards, which are governed by separate policy. The Policy outlines the rights and responsibilities of both the issuer and the holder, providing clarity on the use, redemption, and expiration of these instruments.
Stored-Value Instruments issued by the Spa are designed to retain their value indefinitely, ensuring that the balance remains accessible to the holder at all times. However, in accordance with state regulations, if a Stored-Value Instrument remains inactive for a period of three consecutive years, the remaining balance is required to be transferred to the Texas Comptroller as unclaimed property. Once this transfer has occurred, the instrument is no longer redeemable at the Spa, and the holder must seek recovery of the balance directly from the State.
Stored‑Value Instruments are redeemable only for services or retail products offered by the Spa and are not redeemable for cash except where required by law.
Stored‑Value Instruments should be treated like cash. We are not responsible for lost, stolen, or damaged instruments unless they are linked to a verified client account in our system and ownership can be proven. If the card is linked to your account, we will reissue it electronically free of charge. If you request a replacement physical card, a $10 replacement fee applies; mailing fees may be added, though pickup in‑spa is free.
To protect your balance, purchasers and recipients are strongly encouraged to provide accurate contact information, including full name, email address, phone number and mailing address, at the time of purchase. This information is crucial for maintaining communication and ensuring the security of your Stored-Value Instrument. We recommend creating or linking a client account for the Stored-Value Instrument, as this facilitates easier management and tracking of your balance. Accurate contact details help us send reminders and make it easier to prove ownership if the card is lost or we must remit a balance to the State. Additionally, having a verified account allows for seamless reissuance of lost or stolen cards, ensuring that your funds remain protected and accessible..
Under Texas law, if no activity occurs on a Stored‑Value Instrument for three consecutive years, the balance is presumed abandoned. We are required to report and remit such balances to the Texas Comptroller. When a balance is remitted, the Stored‑Value Instrument can no longer be redeemed at the Spa, though you may claim the funds from the Comptroller.
We will issue courtesy notifications to the most recent email or mailing address on record prior to the three-year anniversary of the last recorded activity.
We do not impose any fees for inactivity or dormancy on Stored-Value Instruments. The sole fee applicable under this Policy is a $10 charge for the reissuance of lost or stolen physical cards.
